These terms of purchase, together with the web order form sent upon accepting them,
constitute a binding contract between the Center and the user (hereinafter, "the Student") who
enrolls in any of the training programs offered by the Center. When submitting their enrollment
request, the Student must tick the "I accept the General Enrollment Terms" box (hereinafter,
"Terms") that appears next to the form; or tick the box "I have read and accept the
terms and conditions of Educa Edtech Group" available on any of the payment gateways and/or
payment methods enabled by the Center. By ticking this box, the Student states that they have read the
present Terms, declares acceptance of them, and grants their express consent to the entire content of the
contract in the version published at the time of acceptance, undertaking to comply with it
without reservation.
1. Identification of the parties
These Terms have been approved by Educa Edtech Group and, therefore, in compliance with
article 10 of Law 34/2002, of 11 July, on Information Society Services and Electronic
Commerce (hereinafter, "LSSICE"), any reference to the "Center" shall be understood to refer to
the entity with which the Student has contracted their training program. These entities are listed in
clause 17 of these Terms. The Student is identified by means of the data
provided in the order or enrollment form, and is responsible for the truthfulness,
accuracy and being up to date. The Student states that they are over EIGHTEEN (18) years of
age, have the legal capacity to enter into contracts, and act either on their own behalf as a natural person or on
behalf of a legal person. In the latter case, the Student expressly states that they have
sufficient power for such representation. The Center may decline to process order requests or
cancel the Student's accounts where the data provided is inaccurate, false or
incomplete.
2. Purpose
This contract governs the terms and conditions applicable to the purchase by the
Student of the Center's training services by means of enrollment in the training
program selected by the Student from among those offered on the Website. These terms are
drawn up and are governed in accordance with Royal Legislative Decree 1/2007, of 16 November,
approving the recast text of the General Law for the Defense of Consumers and Users (hereinafter,
"TRLGDCU"); Law 7/1998, of 13 April, on General Contracting Terms; the
LSSICE; the EU General Data Protection Regulation 2016/679 of the European Parliament and of the
Council, of 27 April 2016, on the protection of natural persons with regard to the
processing of personal data and on the free movement of such data, and repealing
Directive 95/46/EC (General Data Protection Regulation) (hereinafter, "GDPR"), and Organic Law
3/2018, of 5 December, on the Protection of Personal Data and Guarantee of Digital Rights (hereinafter,
"LOPDGDD").
3. Description of products and services
3.1. Various types of training programs are offered on the Website ("Courses"; "Experts",
"Master's Degrees", among others) delivered both in the "distance learning" mode and in the "online" mode
(hereinafter, "the programs" or "the training program").
3.2. Programs delivered in "distance learning" mode are those in which the Student is provided
with teaching materials (typically books, exercise workbooks, printed assessment
tests) to facilitate their study and the completion of the enrolled training program, and the Student must
send the assessment tests set in each case back to the Center by post. In the
"online" mode, teaching materials are available in digital format via an
online platform, through which the Student can pursue their studies and progress through them,
carrying out each of the available practical activities and completing the
assessment tests set.
3.3. The Student will have access to a tutoring service provided by Center teachers, whose activity
will focus on resolving their academic questions; guiding them in their studies; correcting their
practical exercises or other types of assessment tests, as well as providing them with
supplementary study material as deemed appropriate during the period in which the training program is carried out. The
means established by the Center for communicating with teachers will mainly be the virtual campus,
telephone, email, and the other channels made available for that purpose. Should a
training program not include the tutoring service described above, this will be expressly indicated on
the program's information page available on the Center's Website.
The individual page for each training program includes the following information:
- Delivery mode;
- Price;
- Availability of physical materials;
- Delivery timeframes;
- Curriculum; and,
- Other features or aspects the student should take into account.
3.4. Upon completion of the training program, and if the corresponding assessment tests are
passed, the Student will receive a qualification issued by the Center. Some of our training
programs are backed by or delivered in collaboration with third-party entities (Universities, Business
Schools, etc.) and, therefore, additional requirements may be required to obtain them,
such as, for example, a number of accesses to the content; completion of a minimum number of hours of study;
passing various assessments with a specific grade, etc. In all cases, this will be provided to the Student both
in the Website information for each training program and in the information provided by the
Center's teachers, at all times, including the existence of any specific
deadlines for completing the training programs.
3.5. Teachers are solely responsible for and competent to assess whether the various
tests and projects set are passed or failed by the Student. Under no circumstances shall payment for the training
program entail the mandatory issuance and subsequent dispatch of the relevant qualification, as this
is subject to fulfillment of all of the requirements previously communicated by
the teachers. Within the framework of our training programs, it is essential to ensure academic
integrity and the authenticity of the projects submitted by our students. To this end,
training programs are subject to an anti-plagiarism policy designed to safeguard intellectual
honesty and promote an ethical educational environment. This policy means that all activities and
projects submitted by the Student may be subject to thorough verification measures to
ensure their originality. These measures may include, but are not limited to, the use of
advanced plagiarism-detection tools; expert manual review; comparison
with relevant reference sources, among other tools established by the Center.
The results of the above-mentioned check will be communicated to the Student. In the event of a
plagiarism percentage equal to or greater than 25.00%, this will result in a fail grade for the
submitted Project.
3.6. Final Projects or Papers required to pass certain training programs are
not subject to a maximum correction period by the teachers and, therefore, taking
into account their expertise and their level of dedication and excellence in their work, they enjoy full
independence and freedom at an academic and professional level, and may take the necessary time
required to ensure the originality, coherence, and any other attributes that
a Project of this scope must have.
3.7. The Center will inform the Student of the maximum time available to complete the
training program in which they have enrolled. Once the corresponding period has elapsed, the Student
will be granted a free extension (teaching staff will inform the Student whether or not they are entitled
to a free extension) counted from the originally scheduled completion date. Once this period
has elapsed without the requirements communicated by Center staff having been met, the training
program will be considered concluded, and the Student will not be entitled to demand the issuance of the
corresponding qualification, while retaining access to the online campus in strict view-only
mode, with no possibility of making further progress or submitting tutoring requests. Likewise, it will be a
mandatory prerequisite for completing enrolled training programs, and for the issuance and
dispatch of the qualification, to have completed the minimum training period, which is ONE (1) day per
every EIGHT (8) hours of duration of the training program taken. The approximate period for
issuing the corresponding qualification is between FOUR (4) and SIX (6) months from the
formal completion date. This period is established for the purpose of carrying out a thorough
issuance process, ensuring the accuracy and integrity of the document. Official qualifications
issued by Educational Institutions are subject to specific issuance periods
which the Student must check with the Center.
3.8. The Student accepts that the aforementioned period may be extended due to exceptional
circumstances or force majeure. Should the Student require additional information or have
questions about the status of the request, they are encouraged to contact the Student
Support department. Notwithstanding the above, the Student will have a maximum period for
completing the training program in which they have enrolled. Should this period elapse without
having taken the final assessment tests, the training program will be considered concluded without
issuance of a qualification. In such case, the Student may request a paid extension of their enrollment for an
additional period of the same duration as the one originally established for the training program, with the
possibility of taking the assessments and obtaining the qualifying certificate. The costs inherent
to the enrollment extension are as follows:
| Training Program |
Extension Cost |
| Courses/Experts/Higher Courses/Postgraduate |
€85.00 |
| Master's Degree |
€495.00 |
If the cost of an enrollment completed by a student is lower than €85.00 or €495.00, according to
the table above, the cost for extending the enrolled training program will
match the amount originally paid by them for their enrollment. *Training Programs
taken through Continuing Training for workers and companies do NOT include an additional free
extension. Once the maximum period set by the Center has elapsed without the requirements
inherent to such training programs having been met, the Student may extend the period of their training program
by paying the academic fee communicated by the Center.
3.9. The Center reserves the right to cancel the Student's enrollment, without the Student being entitled to
a refund and/or to have pending installments canceled, in the event of making obscene comments;
disrespecting teachers or the Center's staff; infringing the intellectual property of
the Center's content, as well as any other circumstances that could damage the image of the
Center.
3.10. Policy on the Issuance of Duplicate Qualifications and other Academic Certificates. Once the
Student has satisfactorily met all of the academic requirements set by the
Center and those indicated by the teachers, they may request the issuance of the corresponding academic
documentation. This documentation will include the personal information appearing on the identity
document used by the Student to identify themselves with the Center, with no possibility of any
adaptations or amendments being made to such data. Apostilles, certified copies or other operations
requested by the Student regarding qualifications or other academic documents are
subject to special deadlines set by third parties unrelated to the Center and, therefore, will be
communicated to the Student in advance by Center staff. Under no circumstances shall the Center be
liable in the event that the deadlines originally communicated to the Student are exceeded. For further
clarification, the fee schedule that the Student must bear for requesting and
issuing academic documents is set out below:

4. Purchase process
1. Any user can access the information and prices for each training program available on the
Website. 2. Before making a purchase or placing an order, the user may ask any question free of
charge using the chat service, the information form, by phone, or via the email
address listed in the "Contact" section of the Website, having first
accepted our Privacy Policy. 3. If you have decided to complete your enrollment
directly from the Website, the Student must fill in the fields marked as
"mandatory" on the corresponding form. The payment method must be selected and the
required data entered according to the method chosen, as well as ticking the box, if so desired, to
split the payment into installments. For more information, the Student should consult the "Payment
Methods" section of these terms. 4. To complete the purchase process, the Student must
tick the "I accept the General Enrollment Terms" box, which links to this text.
By ticking this box, the Student expressly states that they have read and understood all
the provisions of the contract, and accept them without reservation. The contract shall be formalized upon
receipt of the request by the Center. 5. Upon completion of the process, the Center will send an
acknowledgment of receipt by email or another equivalent electronic means of communication. A
Center enrollment advisor will contact the Student by phone and, if this is not possible,
will contact them by email, in order to confirm all personal details for the enrollment, the payment method, and dispatch
of materials if applicable. Throughout the purchase process, the Student may resolve any questions
using the contact details provided on our Website. Use of these channels for
processing the order will not entail any additional cost for the Student. 6. Once enrolled,
the Student will have access to an intranet called "MYLXP" where they can view the list of
enrolled training programs and consult the general terms accepted by the Student,
so that they remain available for review at all times. 7. Should the enrolled
training program be taken against the training credit available to the/his/her employer,
that is, through "Continuing Training for workers and companies", it must
be taken via the virtual campus of Instituto Europeo de Estudios Empresariales, S.A.U.,
regardless of the Educa Edtech Group entity with which the chosen training program was
contracted.
5. Shipping
If the training program includes teaching materials in physical format, they will be dispatched
via a courier company available in the recipient's area, within 24 to 48 hours from
confirmation of the details in accordance with the "Purchase Process" section of these terms.
The price of the products does NOT include VAT, transport and home delivery. The above rate
does not apply outside mainland Spain (Balearic Islands, Ceuta, Melilla and the Canary Islands); shipping
terms for materials must be checked in advance. Shipments will be sent to the address
provided by the Student during the enrollment process. The Student is responsible for the accuracy
of the delivery address details. The delivery time slot chosen by the Student (mornings or
afternoons) is indicative only, and it cannot be guaranteed that delivery will take place within the
chosen option, although the Center will offer the Student an alternative in the event it is not possible to
deliver under the requested conditions. In the event of any delay in the delivery of shipments, the Student must
contact the Center as soon as possible so that it can offer a solution to the
issue. To report this type of issue, the Student must use any of the contact
methods listed in these terms. Materials that may be included in the enrolled training
program (manuals, briefcases, backpacks, pens, tablets, etc.) will have the cost
indicated on the information page of the enrolled training program.
6. Withdrawal
In accordance with article 102 TRLGDCU, the Student may exercise their RIGHT OF WITHDRAWAL within a
period of FOURTEEN (14) calendar days from the date of receipt of the teaching materials for
training programs in "distance learning" mode, or from the date of receipt of the credentials for
access to the virtual campus in "online" mode. The exercise of the right of withdrawal shall not be
subject to any particular formality; it will be sufficient for the Student to notify the Center of their intention within
the aforementioned period, indicating their name, full address and, if available, their
telephone number and email address; by sending the withdrawal form
available on the website, or by requesting it directly from the Center and subsequently
sending it by email to the Center indicated in clause 17 of these general terms
and conditions; or by returning the teaching materials received, indicating in the
shipment an unequivocal statement of withdrawal and identifying the invoice number or personal data
used at enrollment. Where teaching materials have been provided, the Student
must return them in perfect condition, with return costs being BORNE BY THE STUDENT, as well as
any damage to such materials, in accordance with article 108 of the TRLGDCU. The
return must be made in the same condition in which they were received, which means that the teaching
materials must be returned in a condition that does not indicate improper use or use beyond mere
inspection of their proper condition and functioning. Once the right of
withdrawal has been exercised by the Student, the amounts paid by them will be refunded within the
maximum period of FOURTEEN (14) calendar days, and the enrollment and the Student's access to the
tutoring service and virtual campus will be canceled. Notwithstanding the above, for training programs
delivered in "distance learning" mode, the Center may withhold the refund of the amounts until
it has received the teaching materials to be returned by the Student. Should the Student have
completed the training program in full, having submitted the assessment tests to obtain
the qualification on or before the date of their notification of exercising their right of withdrawal,
such right shall not apply, in accordance with article 103, a) TRLGDCU.
7. Complementary services
As an additional service to the enrolled training program, the Center provides the Student with
a national internship placement scheme (Spain; other countries to be discussed with the Center) to enhance
academic training, aimed at facilitating employment and the acquisition or updating
of professional skills. Such services will be subject to specific terms that the
Student must accept before undertaking them. Under no circumstances shall the Student be subject to
payments or other obligations for services other than those covered by these terms without
their express prior consent. The deadline for requesting an internship placement is THREE (3) months from
the completion notice for "Course" training programs or programs of equivalent duration
and number of hours; and SIX (6) months for "Master's Degree" training programs or equivalent
duration and number of hours. In the case of "Master's Degrees", the Internship Department will have ONE (1) year to
carry out the process of finding companies. For internships in "Course"
training programs, the Center will not carry out any activity related to finding external internships
(although it will carry out the document management inherent to internships), and this will therefore
be the sole responsibility of the student. The period for finding and starting the internship must coincide with the
THREE (3) month period set for requesting the internship. The completion of this type of internship may
be limited due to the student's personal or professional situation, specifically, due to the
conditions required by the entities hosting the students, or due to
temporal or geographical availability. Notwithstanding the above, the Center will make every
effort to find an alternative. This service is complementary and, under no circumstances, can it be
understood that the Center's entire training catalog directly includes this option for
the Student. Center staff will therefore be responsible for informing the Student about
this option. In any case, in order for the Student to be able to request this service referred
to in this clause from the Center, at least 60.00% of the total enrollment fee must have been paid, and
60.00% of the progress in the enrolled training program must have been completed.
7.1. Internship rejection policy. The Student may reject a maximum of TWO (2) companies where
they could complete their internship. The following shall not be valid reasons for rejecting an internship: failure to
obtain financial aid; the inability to join the workforce of the company where the internship would take place; and
any other circumstances not resulting from force majeure events.
8. Economic terms
The price of each training program is shown on the individual page accessible on the Website, without
the need to provide data, register or enroll beforehand. This price includes
all applicable taxes and shipping costs, and represents the total amount to be paid by the Student.
Where offered for a given training program, the total price may be split into installments if
the Student requests this when selecting the "payment method", a window will appear showing the terms
over which payment may be split, depending on the total amount and the payment method. Splitting the payment into installments will not,
unless otherwise indicated, entail interest or additional costs for the
Student. Splitting the payment into installments gives you the option of choosing the one that best suits
you from among our available payment options. As a Center subscriber, you will be charged once a month on the day
you subscribed, until all selected installments have been paid. Once the FOURTEEN (14) days
provided for exercising the right of withdrawal have elapsed, both the Student and whoever undertakes
to make the payment — that is, should this obligation fall on a third party — jointly and severally undertake
to pay the full amount of the contracted training program. In the event of non-payment
of an installment by the Student, the Center is entitled to claim the full amount of the debt, both
the amount already due and the amount still outstanding. Likewise, any applicable installment will include the
banking or administrative costs that may arise from the failure to comply with the payment obligation, such costs
being borne by the persons under such obligation. The mere fact of not paying the enrollment fee or any of
the installments agreed with the Center or with the financial institutions chosen during
the enrollment process, according to the due dates established for each payment method, may result in the
temporary suspension of the student's access to the teaching content and, where applicable,
the cancellation of the enrollment and of any effects it may have had, with no right to a refund. The
Student is obliged, by accepting these Terms, to pay the total price of their
enrollment regardless of whether they decide to abandon the training program during the
periods in which it is delivered.
8.1. Accepted payment methods
The following is the list of payment methods available on each of the Websites:
- Cash on delivery (method available for Spain): You may pay for your purchases directly to the
carrier upon receiving the order.
- Card: You may pay the full amount of your purchase using your card via the
payment gateway. For payment to be accepted by the system, it is essential that
the credit card has online payments enabled.
- PayPal: You may pay for your purchases via the secure PayPal payment gateway, which is directly
integrated into our website.
- Bank transfer: If choosing this payment option, you must pay the corresponding amount
via a bank transfer to one of our accounts (you must state your identification number in the
transfer reference so that the transaction can be correctly identified). Payment by
check or similar means will not be accepted into any of our bank accounts.
- Payment may also be made through the financing options available on the payment gateway, once
the training program has been chosen and enrollment confirmed by the student.
- Other payment platforms are available, such as Flywire, Dlocal, Adyen, Ebank, and Stripe.
- Bizum. The payment methods listed here will only be available for certain
training programs.
8.2. Financing partners
The Center has entered into agreements with leading financial institutions, both nationally
and internationally, in order to offer its students the best options for financing their enrollment fees.
Should a student choose to pay for the training program contracted with the Center through any of
the financial institutions available on its website as 'payment methods', the issuance of the qualification
will, in all cases, be subject to the student paying in full the installments agreed with
the chosen financial institution.
The user accepts that all of their personal data may be transferred in full to Aplazame, Sequra or
the financial institution offered on the website, from the moment the user has begun
contracting the deferred payment service offered by the latter when choosing the payment
method. This acceptance extends to third-party entities that may need to
access the files for the proper performance of the contract.
8.3. Payment methods
To proceed with payment, the student must follow each and every one of the instructions displayed
during the contracting process described above. All payment methods made available by the
Center are subject to checks and authorizations by the issuing entities of the
payment method (card issuers and/or payment account issuers), but should such an entity not authorize
the payment, it will not be possible to continue with the purchase process initiated,
and the purchase and/or order will be automatically canceled, with the requested contracting of the
service being deemed not to have taken place. The charge for the price of the services, shipping costs
(where applicable), and any applicable taxes will only be made when
the contract is formalized, unless the Center states otherwise. To carry out the
electronic payment, the Center has installed an e-commerce payment gateway provided
by authorized financial institutions. All data provided to the Center is duly
encrypted to ensure maximum security and confidentiality, and is hosted on a secure
server certified under the "Secure Socket Layer" (SSL) protocol. Under no circumstances will
the Center store the card details provided by the student via the payment
gateway; they will only be retained while the purchase is being made, while payment is
processed, and until the withdrawal period has elapsed, in order to be able to refund the
corresponding amounts. Financing terms will correspond to those agreed by the student
with the financial institutions chosen by them during the enrollment process and the signing of the
financing agreement.
8.4. Payment default
In the event of default by the party obliged to pay, in accordance with these Terms, and this
section applying to deferred payments, the party obliged to pay shall be liable not only
for the payment of the outstanding principal amount, but also for any applicable late-payment interest. If, following
notification of non-payment by the Center, no satisfactory response is received from the party obliged to
pay, they will be required to pay the outstanding amount within a maximum period of SEVEN (07) calendar
days. Should this period not be met, the following actions may be initiated:
appropriate legal measures for the collection of the debt; and the invoicing of costs arising from
debt-collection management, which must be borne in full by the party obliged to pay, in
accordance with applicable legislation. The party obliged to pay will also have the option of
contacting the accounting department to explore settlement options and avoid the accumulation of interest and
additional costs. As a precondition for enrolling in a new program or issuing qualifications or
certificates, the Center requires payment in full of any outstanding amounts corresponding to any
previously enrolled training program, as well as any late-payment interest or banking and
administrative costs that may arise.
9. Intellectual and industrial property
All elements of the Website, the platform and the training programs are the exclusive property of the
Center, or the Center holds authorization or a license from the holders of the exploitation
rights thereto. Likewise, all trade names, trademarks or distinctive signs, logos, symbols,
combined, figurative or word marks appearing on this Website belong to the Center or the Center holds,
under prior authorization, the right of use thereof, and are protected by applicable
legislation in that regard. By enrolling in a training program, the Student receives a license to use
its content, of a limited, non-exclusive and non-transferable nature, and this shall therefore not
extend to third-party users, nor to any other companies or entities with which
the Student has or may have any shareholding or business relationship. The Student may not,
under any circumstances, unless the Center's express written consent has been obtained:
- Provide or disclose their username and access password to third parties;
- Allow third parties access to the contracted course's content;
- Distribute, communicate, reproduce or copy the course content, on any medium or format.
Failure to comply with this clause shall be cause for early and automatic termination of the
contract, with no need for prior notice, all without prejudice to the Student's liability
for any infringement of the intellectual and industrial property rights held by the
Center or by third parties. Any use or service not expressly authorized under these
Terms must be requested by the Student from the Center, so that it may consider a possible
extension of the license or the contracting of new services, under such terms as the parties
may agree. The Student may not, under any circumstances, hide, harm, or obscure the visibility of
the Center's trademarks, logos, corporate name or other industrial and/or intellectual property rights over
the platform or the teaching content. Intellectual and industrial property
rights shall subsist over the platform and all its content, and the Student must respect them
and, therefore, may not, for example, delete or hide them. Any infringement of the
intellectual and industrial property rights held by the Center, or by its associated
and collaborating entities, entitles the Center to cancel and/or annul orders or enrollments
completed by the infringing natural or legal persons.
10. Other educational institutions
Entities wishing to purchase training programs from this website in order to offer or distribute
them to their own Students, whether companies or individuals, must first request
the Center's express authorization to include them in their catalog which must always
provide clear and unequivocal information regarding the role played by the Center as the
training provider, such entities being limited to presenting themselves as offering or consulting
firms. Under no circumstances may they include in their catalogs the Center's training
programs that are officially recognized, accredited or delivered jointly with other educational
institutions, especially university degree programs. Once authorization has been obtained,
these centers must publish the training programs at a price higher than the one
set for it on the Center's website.
11. Language
These terms are drawn up in the Spanish language. The Center may translate these
terms, as well as the privacy policy or any other operating rule, policy or
procedure that may be published on the Website. Notwithstanding the above, the version in
Spanish shall prevail in the event of any conflict.
12. Data protection
In accordance with the GDPR and the LOPDGDD, we inform you that your data will be incorporated into
the Center's data-processing system for the purpose of handling your inquiries and performing the contract to
which the data subject is party. In compliance with applicable legislation, the Center informs you that the data
will be retained for the period strictly necessary to comply with the aforementioned provisions.
The Center informs you that it will process the data lawfully, fairly,
transparently, appropriately, relevantly, in a limited manner, and accurately and kept up to date. In this
regard, the Center undertakes to take all reasonable measures to ensure that it is erased or rectified without undue delay
where it is inaccurate. In accordance with the rights afforded to you under applicable data
protection legislation, you may exercise the rights of access, rectification, restriction of processing, erasure,
portability, and objection to the processing of your personal data by sending your
request to the postal address indicated above, or to the email address lopd@innovanet.org.
The processing of your personal data is legitimized, once you have given your consent,
in accordance with article 6.1 letter a) of the General Data Protection Regulation. We inform you that you may
withdraw the consent given to receiving commercial communications at any time by
sending an email to the following address: lopd@innovanet.org.
You may contact the competent Supervisory Authority to file any complaint you deem
appropriate.
13. Applicable Law and Jurisdiction
These terms are governed by Spanish law. Any dispute or question regarding the Website
or these legal terms shall be resolved by the Courts and Tribunals of the city of Granada
(Spain). Should the Student have the status of Consumer or User in accordance with the
definitions of the TRLGDCU, any such disputes shall be resolved by the Courts and Tribunals of
the Student's place of residence. Should any of the provisions contained in this contract be declared null or
without effect, in whole or in part, by any competent court or authority, the remaining provisions
shall remain valid, unless the parties mutually agree to terminate the agreement. The
agreements, clauses and terms comprising this document constitute the formal and
final expression of the will of the parties, and are to be interpreted in light of one another,
any doubtful provisions being given the meaning arising from the whole. The Student also has
access to an online dispute-resolution system managed by the European Commission, available at the
following link: https://ec.europa.eu/consumers/odr/main/index.cfm?event=main.home.show&lng=ES
In accordance with the TRLGDCU, please note that: "Consumers and users have the
right to require the Center to formalize a contract; the education provided, unless otherwise
stated, is not part of official regulated education (Early Childhood Education, Primary
Education, Secondary Education, Official Vocational Training, Baccalaureate, University
Degree, Official University Master's Degree and Doctorate). It is therefore complementary and/or
specialized training, aimed at the acquisition of certain professional competencies,
skills or abilities, which may be scored as merit for public-employment recruitment pools and/or
competitive exams, always under the Complementary Training and/or Continuing Training
category, it always being essential to check the specific merit-scoring requirements of the
particular public-employment pool one wishes to apply to. In this regard, the Center is not
responsible for the validity or the scoring of the training programs taken in the various
competitive-examination or selection processes".
The Center has Complaint and Claim Forms available to users who
request them. To do so, they may write to the email address indicated on
the virtual campus or on its Website.
14. Legal guarantees regarding the supply of digital content or services
- In the event of any lack of conformity at the time of supply of digital content or
services, whether this involves a one-off or continuous supply, the Student shall be entitled to remedies for
any lack of conformity that becomes apparent during the period in which the
enrolled training program is delivered, counted from the date the access credentials to the online
campus were provided.
- By means of a simple statement, the consumer may require the Center to remedy any lack
of conformity, reduce the price, or terminate the contract.
- Any lack of conformity that becomes apparent during the period in which the
training program is delivered shall be presumed to have already existed when the digital content or service was
supplied.
Bringing the content or service into conformity must comply with the following rules:
- It shall be free of charge for the Student.
- It must be carried out within a reasonable time and without significant inconvenience for the consumer,
taking the circumstances into account.
The Student may demand a price reduction or termination of the contract.
- The price reduction shall be proportional to the difference between the value of the content or
digital service as it should have been supplied and the value of what the Center actually supplied.
- In the case of contracts for supply over a period of time in exchange for a price, the
reduction shall be applied to the period of time during which the digital content or services were not
conforming.
- Termination shall not apply where the lack of conformity is of minor importance.
The Student may choose these options when the remedy has not been possible for the
following reasons:
- The remedy is impossible or disproportionate.
- The Center has not brought the goods into conformity.
- A new lack of conformity appears after the Center has attempted to bring the
digital content or services into conformity.
- The lack of conformity is so serious that it justifies termination or a price reduction.
The Center shall be obliged to carry out the following actions:
- It shall refund the consumer all amounts paid under the contract.
- It shall comply with data protection legislation.
For their part, the Student shall:
- Not use the content or make it available to third parties.
- Where the digital content has been supplied on a tangible medium, the Student or
user shall, at the Center's request and expense, return the tangible medium to the Center without
undue delay.
- Not be liable for any payment for any use made of the digital content or
services during the period prior to termination of the contract during which the content or
services did not conform.
